:: BOOKING TERMS

 


When planning your travels it is easy to be swept away by the holiday spirit and overlook details which are not part of your holiday dream. However, the booking terms and conditions are very important as it forms the basis of your agreement with Mbango Safaris and we ask you to read them carefully. In particular, the booking terms and conditions detail our responsibilities to you and yours to us and provide guidelines to cover circumstances which may arise. When you acknowledge agreement of our booking conditions via our online booking form, you are confirming that you have read the booking terms and conditions and agree to be bound by them.

Reservations and payments. Reservations for a hotel, safari, tour, day trip requires the filling of online / booking form. When asking for your tour to be confirmed you must provide Mbango Safaris with half of the amount against the cost of the services you have asked for us to arrange. A binding contract between Mbango Safaris comes into existence once we have accepted your booking and issued a confirmation message. The date of the contract is the date, which appears on that confirmation message. The balance of the cost must be received not later than 30 days prior to the commencement date of your safari, tour or holiday. If payment is not made in full by the due date, Mbango Safaris reserves the right to treat your booking as having been cancelled by you and apply the cancellation charges set out in cancellation charges paragraph below. If the reservation is made within 30 days of departure the whole amount must be paid at the time of confirmation.

Rates includes.
� Rates include all expenses in connection with vehicle, driver and guide for the itinerary as set out in the tour plan.
� Hotel accommodation with full board table d'h�te meals whilst on safari in most instances.
� Meal arrangements elsewhere as specified in the tour plan.  
� Local air costs for scheduled flights e.g. Nairobi to Maasai Mara - are included.  
� Government hotel taxes.  
� Hotel service charges.
� Game drives / bird walks as applicable to the itinerary.  
� All national park, reserves and conservation areas fees except where these are specifically quoted as exclusions. 
� Air / Road rescue emergency evacuation coverage.
� Baggage handling assistance is provided by hotels or by the guides when and where necessary.  
� All accommodations as described in the tour plan and are based on double occupancy. Single supplements are also available.
� Professional guiding service (naturalist, ornithologist and multilingual guides where applicable). 
� Comfortable game viewing in specially outfitted 4x4 safari vehicles with guaranteed window seat for all tour participants.   
� Daily safari briefings so you'll know what to expect on the day ahead and a general briefing before starting your safari.  
� Guaranteed departures for one or more passengers booking any safari.  

Rates excludes. Departure taxes, travel cost (air fares) and insurance, visa's costs, immunizations, excess baggage charges, optional excursions, gratuities (other than service charges), beverages, laundry and other such personal expenses such as communication costs.

Safari cost. Mbango Safaris reserve the right to increase or decrease holiday prices at any time before your booking is made should a need be. You will be given the current price at the time of booking and the prices are all in either Pounds, Euros or in US Dollars.  Mbango Safaris do not intend to surcharge any of these prices once they are confirmed but we reserve the right to correct errors in advertised and confirmed prices. We will do so as soon as we become aware of the error.

Transfer of a booking. There is a right for tour participants to transfer their bookings to another person if they are prevented from proceeding with the tour due to sickness or accidents suffered by them or their close family or for other unavoidable reasons.  However, if there is a waiting list for the tour the place must first be offered to the people on that waiting list. If there is no waiting list and participant can find another person to take up the place any additional costs incurred by us will be transferred to the transferee. These are most likely to relate to flights, as penalties are frequently charged for changes of names on air tickets, and for a new evacuation cover as names cannot be changed on these. Reasonable notice must be given to us about the transfer and cannot be made within 28 days before departure date.

Financial security. We operate a client뭩 account where all advance payments are placed and are not withdrawn until the completion of the tour. This is for security purposes incase of need for refunds to be made.

Cancellations. We reserve the right to cancel any tour or tour extension for which there are insufficient reservations before departure. Please note that although unlikely, this could occur after the final invoices have been sent out if the tour is running on small numbers and if someone cancels before the deadline. Incase of cancellation, all deposits and other payments will be refunded as outlined under 'by you and by us' below.

Please also note that the cancellation of a tour's pre-tour or post-tour extension does not alter your rights or obligations with respect to the main portion of the same tour.

Cancellations by you: Should you need to cancel you must notify Mbango Safaris immediately. The following cancellation charges will be payable. 35 - 21 days prior to safari date 25%, 20 - 14 days prior to safari date 50%, 13 - 5 days prior to safari date 75% and 4 - 0 days prior to safari date 100%.

Cancellations by us: Although it rarely happens, Mbango safaris do their utmost to avoid doing so; we reserve the right to cancel tours and other arrangements. Where your holiday is cancelled (other than due to your default in payment) Mbango Safaris will offer you the choice of purchasing an alternative holiday (and paying or receiving a refund in respect of any price difference) or receiving a full and immediate refund of all money paid to us.

In addition, Mbango Safaris will pay your compensation in accordance with and limited to the scale set out below except where Mbango Safaris is forced to cancel as a result of unusual and unforeseeable circumstances beyond our control, the consequences of which Mbango Safaris could not have avoided even with due care such as these amounting to "force majeure" as described below or because an insufficient number of people have booked the chosen holiday - in this case you will be notified not less than 30 days before the commencement date of the holiday.

Period of notification given prior to your departure date. Compensation or credit per person. More than 56 days Nil, Within 56-43 days US $ 25, Within 42-29 days US $ 45, Within 28-15 days US $ 65 and Within 14 days or less US $ 90.

Very rarely, Mbango Safaris maybe forced to curtail the holiday after departure where circumstances amounting to "force majeure" arise. In this very unusual situation, Mbango Safaris regret they cannot make any refunds or pay any compensation or be responsible for any cost expenses incurred by you as result.

Please note that cancellations of a tour뭩 extension do not alter your rights or obligations with respect to the main portion of the same tour.

Changes. By you: Should you wish to make any changes to the confirmed arrangements; Mbango Safaris will endeavor to assist. An amendment fee per person is applicable.

By us: We reserve the right to make changes to tour plans and holiday arrangements and correct errors both before and after you have booked the holiday. Most changes will be minor. However, occasionally, Mbango Safaris has to make significant changes to holiday arrangements. In the event of significant change, Mbango Safaris will inform you or you travel agent at the earliest possible opportunity. In such cases you will have the choice of either accepting the change or booking alternative arrangements (and paying or receiving a refund in respect of any price difference) or canceling the holiday and receiving a full immediate refund for all monies paid to us. In addition, in the case of significant change, Mbango Safaris will pay you compensation in accordance with, and limited to, the scale set above under the heading "Cancellation by Mbango Safaris" subject to the following exception. No compensation will be paid and no liability beyond offering the above mentioned choices can be accepted where the changes is made as a result of unusual and unforeseeable circumstances beyond Mbango Safaris control, the consequences of which Mbango Safaris could not have avoided even with all due care such as those amounting to "force majeure" as described below. No compensation in the case of minor changes.

Mbango Safaris has taken all reasonable steps to ensure that the suppliers of all services provided are of acceptable standard. No liability can be accepted for negligent acts or omissions of hotel accommodation providers, any liability for loss, damage or expense resulting from war or threat of war, terrorist activities, riots, civil unrest, natural and nuclear disasters, fire or adverse weather conditions, closure of airports, industrial disputes including air traffic control disputes, cancellation or changes of schedule by airlines, financial failure of airlines, or for any unusual and unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised, or due to an event which, even with all due care, we could not foresee or forestall.  

Force Majeure. Throughout the booking conditions, the expression "force majeure" means any event which Mbango Safaris could not have foreseen or avoided even with all due care. Such events may include war or threat of war, riots, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, governmental control." In these circumstances Mbango Safaris shall not be liable to pay any compensation or otherwise be responsible for any expenses or losses you incur where Mbango Safaris is forced as a result to cancel, delay, curtail or change your holiday arrangements in any way or where the performance or prompt performance of Mbango Safaris contractual obligations is prevented or affected. Except as provided in cancellation by Mbango Safaris and changes by Mbango Safaris.

Complaints. Mbango Safaris hope you will not encounter any problems during the holiday. However, should one arise, please immediately advice us of the service in question as most problems can be solved straight away. Mbango Safaris regret that they cannot accept responsibility for any complains which are entirely in accordance with this close.

Delays. No arrangements are made by Mbango Safaris concerning the provision of local and international flights from the UK or Europe and within East Africa. Therefore all outward and homeward points of departure should be read in relation to the services which Mbango Safaris have contracted to provide and not any flight or other travel arrangements which may have been added on.  

In case of any delay at the commencement of Mbango Safaris services, we will do our best to provide light refreshment for delays between 2 and 4 hours, and meals at meal time for delays over 4 hours.

Changes and errors. Please note the information and prices may change by the time you book your holiday. Whilst every effort is made to ensure the accuracy of the prices and information, regrettably errors do occasionally occur. You must therefore ensure that you check all details of your chosen holiday arrangements with us or your travel agent at the time of booking.
